目的探讨职业卫生投诉的原因、特点以及处理这类案件存在的问题和对策。方法对2002—2009年深圳市宝安区职业卫生投诉案件进行统计分析。结果实名投诉占97.5%,投诉职业病诊断和职业健康检查的案件占75.0%。职业卫生投诉案件呈逐年增加趋势,以极端方式反映诉求的现象值得关注,现行的职业卫生法律不健全。结论《中华人民共和国职业病防治法》及其配套规章应进行修订完善,卫生监督机构应加强对卫生监督人员的专题培训,切实维护劳动者健康权益。
Objective To investigate the causes and characteristics of occupational health complaints and to deal with the problems and countermeasures in such cases. Methods A statistical analysis of occupational health complaints in Bao'an District of Shenzhen City from 2002 to 2009 was conducted. Results of real name complaints accounted for 97.5%, complaints of occupational disease diagnosis and occupational health examination cases accounted for 75.0%. The cases of occupational health complaints have been increasing year by year. It is noteworthy to reflect the demands in an extreme way. The existing laws on occupational health are not perfect. Conclusion The “Law of the People's Republic of China on Prevention and Treatment of Occupational Diseases” and its supporting regulations should be revised and perfected. Health supervision agencies should strengthen the special training of health supervisors, and earnestly safeguard the rights and interests of workers.
