多哈回合的第一项早期成果《区域贸易协定透明度机制》,对于举步维艰的WTO有关RTAs约束机制的谈判而言,无疑是一缕曙光。本文对于该文件的制定背景、主要宗旨、基本依据进行了梳理,认为该文件有五项重要突破:广泛而又区别对待的适用范围;独立的早期通报程序;明确的通知时间与内容;全面的成员评议程序并由WTO秘书处制作事实报告;强制的后续通知与报告程序,进而对这些突破作了评析。
The first early result of the Doha Round, the “Transparency Mechanism for Regional Trade Agreements,” is undoubtedly a ray of hope for the tough negotiations on the binding mechanism of RTAs by the WTO. This paper reviews the background, main purpose and basic basis of the document. It considers that there are five important breakthroughs in the document: the scope of application of broad and differentiated treatment; the independent early notification procedure; the explicit notification of time and content; the comprehensive Members reviewed the procedure and made factual reports by the WTO Secretariat; compulsory follow-up notification and reporting procedures were followed to comment on these breakthroughs.
