过去十年,WTO一路坎坷,发展中国家和发达国家之间的分歧有增无减。在目前的状况下,不合时宜、不谨慎地提出新议题都只会加深双方的互不信任并对WTO的发展前景造成破坏性的影响。相互承认外国法院判决恰巧就是这样一个提议。试图将如此敏感的话题在由最广泛也最复杂的成员方构成的WTO体制内讨论,是非常不成熟的。在有关成员方单边利益驱动下,不平等总是充斥在貌似平等的WTO规则之下,这种单边主义在WTO决策程序中尤为明显。
In the past 10 years, the WTO has been bumpy and the differences between developing and developed countries have been on an ever increasing scale. Under the current circumstances, outdated and inadvertent proposed new issues will only deepen mutual trust and cause devastating effects on the development prospects of the WTO. Mutual recognition of a foreign court decision happens to be such a proposal. It is immature to attempt to discuss such a sensitive topic in the WTO system consisting of the broadest and most complex members. Driven by the unilateral interest of its members, inequality is always filled with seemingly equal WTO rules, which are particularly evident in the WTO decision-making process.
