国际民事诉讼中法院判决的承认与执行是国际民事诉讼程序的最后阶段,同时也是整个国际民事诉讼程序的归宿。在决定是否承认与执行外国民商事判决时,管辖权是法院首先遇到的问题。各国立法一般都将原判决国法院对案件具有合格的管辖权作为承认和执行外国法院判决的先决条件,即承认国在承认或执行外国判决时,首先要审查该外国法院对案件是否拥有管辖权。对于具体案件来说,法院具有管辖权是法院受理该案件并作出有效判决的前提,只有有管辖权的法院才有资格对案件
The recognition and enforcement of the court judgment in international civil litigation is the final stage of the international civil procedure and also the fate of the entire international civil procedure. Jurisdiction is the first issue courts face when deciding whether or not to recognize and enforce foreign civil and commercial judgments. National legislation generally takes the competent jurisdiction of the original judgment court as a precondition for the recognition and enforcement of a foreign court judgment.
