物业管理条例的规定,物业使用人在物业管理活动中的权利、义务由业主和物业使用人约定,物业使用人违反物业管理条例和管理规约的规定,有关业主应当承担连带责任。这虽然保护了民事主体在民事活动中自由约定的权利,但却忽视了物业使用人作为独立的民事主体应具有权利、义务。本文就物业使用人在物业管理法律关系中的法律地位、应享有的权利和承担的义务进行深入的探索,试图完善物业管理活动,促进物业使用人更有效的行使使用权,物业管理以人为本的宗旨得到进一步的体现。
