物权的设立和转移必须遵循一定的原则。为了完善我国的物权制度,本文对大陆物权法确立的一些基本原则进行了比较系统的分析和考察。在明确各原则的含义、内容和立法依据的前提下,阐述了作者关于制度设计方面的具体意见。它包括,我国的物权制度亦需要贯彻法定原则的原因;国家与国营企业之间设定的权利与一物一权原则的矛盾;物权行为独立原则的时代意义以及公示原则与公信原则功能上的差异等问题。
The establishment and transfer of real rights must follow certain principles.
