我国现行宪法是国家的根本法,是中国特色社会主义法律体系的核心和基础,它规定国家的根本制度和根本任务,并对公民的权利和自由予以确认和保护。私有财产权是公民的一项基本权利,它与生命权、自由权一起被称为公民的三大基本权利。宪法理所当然地应对公民的私有财产权作出原则性的规定,然后再通过物权法等民事法律依据宪法确定的原则制定具体的规则对私有财产权给予保护。财产关系是最主要的经济关系,包括私有财产权在内的各种财产权是财产关系在法律上的体现,属于上层建筑的范畴,归根结底,是反映经济基础并反过来为经济基础服务的。法律通过确认和保护各种合法的财产权,使上层建筑适应经济基础发展的需要。只有构建一套完整的保护财产权的法律制度,才能适应生产力发展的需要,调动广大人民群众创造财富的积极性,促进财富的积累和对财富的合理利用。保护私有财产是保护各种合法财产的一个重要方面。党的十六大提出:“一切合法的劳动收入和合法的非劳动收入,都应该得到保护。”并明确提出“完善保护私人财产的法律制度”的要求。根据党的十六大精神,党的十六届三中全会提出的修宪建
