我国国务院关于修改《全国年节及纪念日放假办法》的决定已于2008年1月1日起施行。在这个方案安排中,国家法定节假日的总天数有所增加,清明节、端午节、中秋节等传统节日被定为国家法定节假日。同一时间,新修订的《职工带薪年休假规定》意见稿也开始向社会公布征求意见[1]。从立法层面上看,这次调整是对我国法定节假日制度存在的许多不合理之处一次重要的改革。这次改革是值得欣喜的,同时也是值得我们深思的。在此,主要通过分析我国法定节假日制度立法的概况和现状,剖析其存在的不足和原因,探讨其改革和完善的方向,希望能够建立一个科学合理、与时俱进、以人为本的法定节假日法律制度体系。
The decision of the State Council of China on amending the “Measures for the Holiday of the National Day and Memorial Day” came into effect on January 1, 2008. In this program arrangement, the total number of national statutory holidays has increased, and traditional festivals such as the Ching Ming Festival, Dragon Boat Festival and Mid-Autumn Festival are designated as national holidays. At the same time, the newly revised “Workers' Annual Leave with Pay Regulations” has also been put forward to the public for comments [1]. At the legislative level, this readjustment is an important reform of many unreasonable places in the statutory holiday system in our country. This reform is delightful, but it is also worth our consideration. Here, we mainly analyze the general situation and status quo of legislation on statutory holiday system in our country, analyze the shortcomings and causes of its existence, and discuss the direction of its reform and improvement, hoping to establish a legal system of scientific and rational, advancing with the times and people-oriented legal holidays system.
