新修订的《劳动合同法》于今年7月1日正式实施,同时实施的还有中华人民共和国人力资源社会保障部的《劳务派遣行政许可实施办法》。8月,该部又将《劳务派遣若干规定(征求意见稿)》向社会公开征求意见,这些法律、法规的实施,为律师提供了法律服务的新机遇。根据人保部的统计,我国劳务派遣在2008年时是2000万人,到2010年达到了4700万人,人数翻了一番。目前我国职工总数大约为3亿人,劳务派遣的比重已经超过10%。我们在《劳务派遣若干规定(征求意见稿)》中
The newly revised “Labor Contract Law” was officially implemented on July 1 this year. At the same time, the “Measures for the Administration of Labor Dispatch Administrative Permission” is also implemented by the Ministry of Human Resources and Social Security of the People's Republic of China. In August, the Ministry again solicited opinions from the public on certain provisions on labor dispatch (draft for soliciting opinions). The implementation of these laws and regulations has provided new opportunities for lawyers to provide legal services. According to the statistics of the Ministry of Human Resources and Social Security, the number of dispatch labors in China is 20 million in 2008 and reached 47 million by 2010, doubling the number.
