知识产权是民事权利。在信息社会,知识产权日益重要,我国制定统领信息社会经济生活的民法典,须明确对知识产权做出规定。在我国,知识产权诉讼还包括了针对行政执法的司法审查和侵犯知识产权的刑事救济程序,知识产权审判专业化趋势尤为明显。民法典与知识产权法逻辑关系,应当是在拟定的《民法总则》中明确知识产权的概念、基本内容以及不同于物权的主要规则。既彰显知识产权在社会经济中的重要性,又为将来知识产权制度进一步体系化提供索引。
Intellectual property is civil rights. In the information society, the intellectual property is becoming more and more important. Our country must formulate the civil code that will guide the economic life of the information society. In our country, the litigation of IPR also includes the judicial review against administrative law enforcement and the criminal remedy procedure of IPR infringement. The tendency of IPR trial specialization is especially obvious. The logical relationship between civil code and intellectual property law should be clearly defined in the General Principles of Civil Law, the concept of intellectual property, the basic content and different from the main rules of property rights. It not only demonstrates the importance of intellectual property in the social economy but also provides an index for further systemization of the future intellectual property system.
