增进和维护公共利益是政府的职责,政府是公共利益的代表者和维护者。为了使政府在实现公共利益方面发挥应有的作用,也为了防止政府滥用公共利益侵犯或限制公民的合法权益,有必要厘清公共利益的内涵,并正确定位政府与公共利益的关系。政府在界定公共利益时,要遵循相应的法律原则,建立规范透明的程序制度,保证公众的参与权与表达权。在做出征收等行政行为时,要进行公共利益与私人利益的衡量,如果对公民权益造成损害不可避免,要选择对公民权益损害最小的方式进行。公共利益与私人利益不是对立的,在维护和实现公共利益的同时,也要强调对公民个人利益的保护,公民的信赖利益受到了损失,行政机关要对其损失给予合理补偿。
It is the government’s responsibility to promote and safeguard the public interest. The government is the representative and defender of the public interest. In order for the government to play its due role in realizing the public interest and to prevent the government from abusing the public interest to infringe or restrict the legitimate rights and interests of citizens, it is necessary to clarify the connotation of public interest and correctly define the relationship between the government and the public interest. When defining the public interest, the government should abide by the corresponding legal principles, establish a standardized and transparent procedural system and ensure the public’s right of participation and expression. When making such administrative acts as expropriation, public and private interests should be measured. If the damage to citizens ’rights and interests is unavoidable, we should choose to minimize the damage to citizens’ rights and interests. Public interests and private interests are not opposed. While safeguarding and realizing the public interest, they also emphasize the protection of the individual interests of citizens. The trust interests of citizens have suffered losses. Administrative agencies should provide reasonable compensation for their losses.
