韩国民法中所预想的典型动产担保是动产质权。但是在韩国,除了例外情形以外,动产质权基本上是不被运用的。设定质权需要转移占有,因此并不能将物的使用价值与交换价值分离并以动产提供担保。而且通常动产的价额不大,且其价值具有随着时间的推移而减少的倾向,因此通过动产担保融资较难。为了解决这种问题,发展出了动产让与担保尤其是集合动产让与担保。动产让与担保允许基于占有改定的交付,因此债务人可以利用担保物
The typical movable property envisioned in Korean civil law is the pledge of movable property. However, in South Korea, except for exceptions, the pledge of movable property is basically not applied. The establishment of the pledge needs to be transferred and therefore can not separate the use value of the goods from the exchange value and provide the guaranty for the movable property. Moreover, the price of movable property is usually small, and its value tends to decrease with the passage of time, so it is more difficult to secure financing through movable property. In order to solve this problem, the transfer of movable property has been developed, especially the transfer of movable property. Movable concessions allow for delivery based on possession of the change, so the debtor can use the collateral
