加强党内法规法理研究,既是实现依法治国、提升党内法规法治化水平的要求,也有法学理论的充分根据。软法是相对于“硬法”、“国家法”而言的,党内法规就是规范我国政治运作的软法规范之一。根据当前实际,要重点加强对软法的理念与党内法规的基本原则、软法的生成机制与党内法规立法机制、软法责任实现机制与党内法规实施机制、软法和硬法的衔接机制与党内法规和国家法律的协调机制等问题的研究。
To strengthen the study of laws and regulations within the party is not only a requirement for realizing the principle of governing the country according to law and raising the level of the rule of law within the party’s laws, but also a sufficient basis for jurisprudence. The law of softness is relative to “hard law” and “state law”, and the law of the party is one of the soft law norms that regulate the political operation of our country. According to the current reality, we should focus on strengthening the concept of soft law and the basic principles of the laws and regulations in the party, the formation mechanism of soft law and legislative mechanism within the party, the mechanism of the realization of soft responsibility and the implementation mechanism of the laws and regulations within the party, Cohesion mechanism and the laws and regulations of the party and the coordination of national laws and other issues.
