霍菲尔德提炼出的八个法律概念的“最小公分母”(权利与义务、特权与无权利、权力与责任、豁免与无权力)可以作为分析所有权内部构造的工具。这为重新认识所有权以及阐释所有权内部构造同具体民法制度的关系提供了新的视角。所有权是一种权利,但不仅仅是一种权利,而是法律利益(权利、特权、权力、豁免)和法律负担(义务、无权利、责任、无权力)的集合体。这一认识对于反思学界围绕所有权的定义、所有权的属性、所有权的限制和所有权的对世性等而进行的讨论具有重要的意义。
The “least common denominator” (rights and obligations, privileges and non-rights, powers and responsibilities, immunity and powerlessness) Hohfeld derived from the eight legal concepts can be used as a tool for analyzing the internal construction of ownership. This provides a new perspective for re-understanding of ownership and interpretation of the relationship between the internal structure of ownership and the specific civil law system. Ownership is a right, but not just a right, but an assembly of legal interests (rights, privileges, powers, exemptions) and legal burdens (obligations, no rights, responsibilities, no power). This understanding is of great significance for the reflection on the definition of ownership, the property of ownership, the restriction of ownership and the right of the ownership of the academic community.
