统计表明,截止2012年上半年,我国商标累计申请量、累计注册量分别为1054万件、717万件,有效注册商标已达609万件,均位居世界第一。然而在“商标大国”繁荣的表象下,呈现的却是侵权之风四起的“江湖”图景,其一大根源则是商标法制的缺失。2012年12月24日,商标法修正案草案正式提交十一届全国人大常委会第三十次会议初审,其中备受瞩目的修法努力,正是直面危及市场公平竞争的诸多乱象。
Statistics show that as of the first half of 2012, the cumulative number of trademark applications and cumulative registrations in China amounted to 10.54 million and 7.17 million, respectively, and the number of valid registered trademarks reached 6.09 million, ranking the first in the world. However, under the appearance of prosperity of the “trademark superpower”, the picture of “rivers and lakes” where infringement winds up is presented. One of the major causes is the absence of the trademark legal system. On December 24, 2012, the draft amendment to the Trademark Law was formally submitted to the 30th meeting of the 11th NPC Standing Committee for preliminary examination. Among them, the much-anticipated revisionist efforts are just the face of many chaos that endangers the fair competition in the market.
