美国法学院法律教育缘起于律师职业化教育,其法学教育框架分为法律分析、法律实践和职业发展三部分,以培养律师为使命的法律职业教育直接体现在其课程内容的设置和教学方法上。法学教育所采用的案例讨论教学法和诊所式模式虽取得了成功,但其在实践中所面临的批评依然很多。改革和完善我国法律教育体系,应结合法律制度和实践特点,兼顾教学传统、心理文化,减少其学术性,加强其职业性。
The legal education in American Law School originates from the professional education of lawyers. The legal education framework is divided into three parts: legal analysis, legal practice and career development. The legal vocational education with the mission of training lawyers is directly reflected in the setting of its curriculum contents and teaching methods . The case law pedagogy and clinic model used in law education have achieved success, but the criticisms they face in practice are still numerous. To reform and perfect the legal education system in our country, we should combine the legal system and practice characteristics, give consideration to the teaching tradition and psychological culture, reduce its academic character, and strengthen its professionalism.
