人们到处可听到音乐。但我们的音乐创作者——作曲家和作词家,除了在他们的作品被发表时得到一笔寥寥无几的稿酬之外,并没有因为他们的作品被广泛演奏而收到应得的版权报酬。这首先是由于他们收取版权报酬无法可依,需要尽快制定颁布版权法。其次是由于缺少一种组织为他们依法收取版权报酬,因为创作者本人是不可能到每个播放他作品的商店、餐厅和其他场所去收取版权报酬的。对于制定版权法的必要性,人们早有呼吁;对于建立版权管理组织的必要性,则尚未引起人们的注意。本文介绍了香港一个办得颇为出色的集体管理版权组织——香港作曲家及作词家协会,供各方研究参考。
People can hear music everywhere. But our music creators - composers and lyricists - did not receive due copyright compensation for their work being widely played, except for a few royalties when their work was published. This is primarily due to their inability to receive compensation for copyright and the need to enact a copyright law as soon as possible. Second is the lack of an organization to charge them for legal copyright, because it is impossible for the creator to charge the copyright for each store, restaurant or other place where his work is played. People have long called for the necessity of formulating copyright laws, and the necessity of establishing a copyright management organization has not drawn any attention. This article presents a well-established collective management copyright body in Hong Kong, the Hong Kong Society of Composers and Authors, for reference.
