《中华人民共和国劳动合同法》(以下简称《劳动合同法》)从制定、修改、颁布到实施,引起了社会各界的广泛关注。解雇成本是争议的焦点之一,《劳动合同法》在解雇程序、经济补偿金支付、解雇条件等方面都与《中华人民共和国劳动法》存在不同。《劳动合同法》是否增加了企业的解雇成本?企业能否承受《劳动合同法》的变革?这些问题都值得我们进行深入的研究,本研究以企业态度调查为依据,就《劳动合同法》对企业解雇成本及雇用行为的影响进行了探讨。
The “Labor Contract Law of the People’s Republic of China” (hereinafter referred to as the “Labor Contract Law”) has drawn wide attention from all sectors of society from formulation, revision, promulgation to implementation. The cost of dismissal is one of the focuses of controversy. The Labor Contract Law differs from the Labor Law of the People’s Republic of China in terms of dismissal procedures, payment of economic compensation and conditions of dismissal. Whether the “Labor Contract Law” increases the cost of dismissal of the enterprise? Whether the enterprise can withstand the change of the “Labor Contract Law”? All these issues deserve our in-depth research. Based on the investigation of the enterprise’s attitude, The impact of the layoff cost and employment behavior of enterprises is discussed.
