随着社会的发展,我国城市化进程正在逐步加快。城市居民生活以及政治文化活动、企事业单位生产、政府机关办公、经济运行等等都需要使用和消耗大量物资。这些物资从生产单位送到用户手中将产生大量的货物运输量,而这些货物主要是由机动灵活、“门到门”的道路货物运输(卡车运输)完成。但由于我国许多城市都对货车进城进行限制(尤其在北京、上海等特大城市),许多道路运输企业为了满足物资供给需求、解决送货进城等问题进行违规经营。道路运输企业通常的做法是把中小型客车的后排座位拆除,把客车当货车使用。这就产生了所谓“客车运货”的情况,这种情况存在诸多问题,在社会上反响强烈。本文重点探讨“客车运货”进城的法律问题,并结合国内外有关情况提出改进的建议。
With the development of society, the process of urbanization in our country is gradually accelerating. Urban life and political and cultural activities, enterprises and institutions production, government offices, economic operations, etc. need to use and consume a lot of supplies. The delivery of these materials from the production unit to the users will generate a great deal of freight, which is mainly carried out by road freight transport (truck transport) which is flexible and “door-to-door”. However, many cities in our country restrict the vehicles entering the city (especially in metropolitan areas such as Beijing and Shanghai). Many road transport enterprises conduct illegal operations in order to meet the material supply needs and solve the problem of delivery to the cities. The usual practice for road transport companies is to remove the rear seats of small and medium buses and use the buses as lorries. This has led to the so-called “passenger car freight ” situation, there are many problems in this situation, in the community aroused strong repercussions. This article focuses on the “bus ” into the city of the legal issues, combined with relevant conditions at home and abroad put forward suggestions for improvement.
