我国专利制度中关于“一事不再理原则”的特殊规定造成实践中专利权人为了遏制他人提出无效宣告请求,利用“稻草人”以不参加口审和行政诉讼的方式主动提出宣告自己专利无效的虚假请求,从而得到对自己有利的生效无效审查决定。而当真正的被控侵权人再次通过无效程序请求宣告该专利无效时,专利复审委员会又以“一事不再理”为由,直接援引前次生效无效审查决定的结论,继续维持专利权有效。本文旨在通过探究“一事不再理原则”立法本意,从我国民事法律规范的一般规定和专利制度中的特殊规定出发,剖析我国专利无效审查中适用“一事不再理原则”时前述隐患的形成原因,并借鉴其他国家和地区的类似规定及审查实务,提出解决前述隐患的可行方案,从而规范“一事不再理原则”在专利无效中的适用。

When the hidden dangers of the reasons for the formation, and learn from other countries and regions, similar to the provisions of the review and practice, put forward solutions to the hidden dangers of the program in order to regulate the “principle of non bis in idem” in the patent invalid application.
