【案情简介】原告:吴某,系某物流有限公司职工。被告:某物流有限公司。原告诉称:原告于2007年到被告单位工作,约定月工资1300元。同年12月1日,双方签订书面劳动合同,约定原告从事空插司机工作,合同期限为1年,月工资1300元。2008年8月,原告因病请假治疗,被告于2008年11月10日决定解除劳动合同。在合同履行期间,从2007年5月开始,每天工作12小时,却无休息日,故起诉被告要求给付加班费20829.30元。被告辩称:原告所诉与事实不符。被告不存在拖欠原告加班费问题,原告的加班费在工资表中都以奖金的形式按工资150%给付,即每月900元。

On November 10, 2008, the defendant decided to terminate the labor contract. During the performance of the contract, from May 2007 onwards, work 12 hours a day, but no rest days, it sued the defendant asked to pay overtime pay 20,829.30 yuan. The defendant argued that the plaintiff's complaint did not match the facts. The defendant did not default on the plaintiff's overtime pay.
