基本案情:双手轻轻一挥,一枚戒指缓缓升至半空——这种魔术被称为“漂浮戒指”。2010年8月底,以色列职业魔术师Yigal Mesika以自己研发的魔术(漂浮戒指道具)在中国国内被盗版销售起诉至北京市一中院。这是魔术在国内风靡后,法院受理的首起魔术著作权案。据Mesika称,2009年4月,他便听说中国国内有商家非法复制和出售漂浮戒指相关道具。2009年末,他发现北京某文化发展公司和杨先生在淘宝网上销售漂浮戒指的产品,并称销售的为原版产品。
