悬赏广告,面向不特定的大众,具有隐性的社会效应和经济效应,为许多商家所青睐。然而,悬赏的重金与期待的效应往往又不对称,常常引发悬而不赏的事件。那么,悬赏广告,赏还是不赏?悬而不赏责在何方?一起因重金征名悬而不赏引出的法律问题——一家房产开发公司发布悬赏广告,重金为楼盘征名。市民踊跃参加,却只见参赛进程不见奖赏结果。一位参选市民遂以房产开发公司违反诚实信用原则,存在严重欺诈等为由,将房产开发公司告上法庭,要求房产开发公司支付征名录用奖金。房产开发公司则以该市民的参选作品未能人选为由,拒绝支付任何奖金。那么,悬赏广告,赏还是不赏?悬而不赏责在
Reward for advertising, for a specific audience, with hidden social and economic effects, favored by many businesses. However, the large amount of rewards and the expected effects are often asymmetrical and often lead to overhaul events. Then, reward advertising, reward or not reward? Suspended not reward where? The real estate development company refuses to pay any bonuses on the ground that the public's candidature fails. So, reward advertising, reward or not reward?
