2001年元月3日,河南省新密市恒源造纸厂一纸诉状将新密市人事劳动局推上被告席,并将本厂职工郭建林由原告列为第三人。诉状认为郭建林受伤主要是因为工作期间酗酒、违章操作造成的。人事劳动局认定郭建林为工伤的具体行政行为明显属主要证据不足,程序违法,适用法律、法规错误。请求法院依法撤销被告于2000年10月10日作出的新密人劳字(2000)221号文件《关于认定新密市恒源造纸厂职工郭建林为工伤的决定》。
January 3, 2001, Xinmi City, Henan Hengyuan Paper Mill a paper petition to the Xinmi City Personnel and Labor Bureau onto the dock, and the factory workers Guo Jianlin by the plaintiff as a third person. The complaint states that Guo Jianlin was injured mainly because of alcohol abuse and illegal operation during his work. Personnel and Labor Bureau identified Guo Jianlin specific administrative acts of work-related injuries is obviously the main lack of evidence, the program illegal, applicable laws and regulations wrong. Requesting the court to revoke the “Xin Mi Ren Lao Zi (2000) 221” Document of the Defendant on Dec. 10, 2000, “On Determination of Guo Jianlin, a Staff Worker at Hengyuan Paper Mill, Xinmi City as a Work-related Injury”.
