随着国际法不加禁止行为造成损害后果的国际责任制度的确立,过失责任原则作为国际责任的归责原则以及过失作为国际责任的构成要件开始受到理论界的质疑。本文全面阐述了国际法上的过失的内涵,系统地分析了过失与国际责任的构成、责任性质与责任程度的关系,认为过失是国际责任的构成要件,直接影响国际责任的形式、性质和程度,只是由于现代国际法上的过失与行为违背国际义务在概念上具有同一性,因此,没有必要将过失单列出来作为国际责任的构成要件。
