从《北美劳动合作协议》(1994)和《毛里求斯协定》(1995)到当前已缔结的TPP和正在谈判的TTIP,美欧FTA劳动标准实践形成各自不同的风格,但整体都趋向严格。美欧TTIP劳动标准问题的谈判分歧包含融合的基础,可能出现各自既有实践关键元素的交叉与叠加。美欧FTA劳动标准所折射的贸易协定劳动标准发展趋势对国际贸易法治和中国贸易法治均提出了新要求。中国应以更具建设性的眼光来看待这一趋势,从规范方面完善贸易政策中的劳动标准。
From the “North American labor cooperation agreement” (1994) and the “Mauritius Agreement” (1995) to the currently concluded TPP and the negotiating TTIP, the United States and the European FTA labor standards practices have their own different styles, but the overall trend tends to be strict. Bargaining disagreements over the TTIP labor standards in the United States and Europe encompass the basis of convergence and may involve the intersection and overlay of key elements of their respective existing practices. The development of labor standards in the trade agreements reflected by the FTA labor standards in the United States and Europe has put forward new requirements on the legal status of international trade and the rule of law in China’s trade. China should take a more constructive look at this trend and improve its labor standards in terms of norms.
