在社会转型期,软法更容易适应迅速变化的社会实际。尤其是在繁杂的行政事务中,软法可以发挥更加积极的作用。我们需要挖掘软法在反对暴力恐怖活动、保障民族自治中的潜力,认真研究软法之治同协商民主相互促进、共同发展的制度。在推行软法之治时,应该注意坚持软硬兼施,绝不放松硬法的权威和规范,同时,防止政府俘获的风险,这要特别注意完善和规范作为软法的重要形式的党规党法的制定、实施、监督程序。
