知识产权保护制度自形成以来,其保护力度和广度呈现出不断扩张的趋势。“TRIPS-Plus”是在TRIPS协定实施后发达国家为推行知识产权国际保护高标准的新形式,它所确定的“TRIPS-Plus”标准既使得广大发展中国家承担了高于TRIPS协定标准的知识产权保护义务,还使发展中国家占优势的传统利益受到限制。本文围绕“TRIPS-Plus”协定产生原因、特点、法律依据以及其对知识产权国际保护制度的影响进行了探讨,并提出中国的立场与对策。
Since the formation of the system of intellectual property protection, the intensity and breadth of its protection have shown an ever-expanding trend. “TRIPS-Plus” is a new form developed by developed countries after the implementation of the TRIPS Agreement to promote high standards of international protection of intellectual property. The “TRIPS-Plus” standard set by the TRIPS Agreement not only enables developing countries to undertake higher-than-TRIPS The standard obligation to protect intellectual property rights also limits the traditional interests of developing countries from their predominance. This article focuses on the causes, characteristics, legal basis and the impact of the “TRIPS-Plus” Agreement on the international protection of intellectual property rights, and puts forward China’s position and countermeasures.
