抵押权的实现是抵押权人最重要的权利,也是抵押权最主要的效力。我国《担保法》第53条规定:“债务履行期届满抵押权人未受清偿的,可以与抵押人协议以抵押财产折价或者以拍卖、变卖该抵押财产所得的价款受偿;协议不成的,抵押权人可以向法院提起诉讼。”由于诉讼实现抵押权的方式极大地增加了债权实现的成本,加重了债务人、抵押人的负担,因而广受批评。《物权法》第195条第2款规定:“抵押权人与抵押人未就抵押权实现方式达成协议的,抵押权人可以请求法院拍卖、变卖抵押财产。”
