物权是财产权的重要类型,性质上为支配权、绝对权,产生对抗除物权权利人外任何人的效力,物权对抗力的产生与物权的公示公信不可分离,登记作为部分类型的物权变动的公示工具(生效要件或对抗要件)决定着这些类型的物权效力的有无与射程。我国《物权法》确立了登记生效要件下,未经登记物权变动不发生;登记对抗要件下,物权变动未经登记不得对抗善意第三人,该善意第三人范围的确定宜采有效、有偿交易且主要义务已履行说。
Real right is an important type of property right, which is dominated and absolute right in nature. It has the effect of antagonizing anyone except real right owner. The production of real right confrontation can not be separated from the public credit of real right. Registration as a part of the Publicity changes tools (effective or confrontational requirements elements) determines the effectiveness of these types of property rights and without the scope and range. Under the “Real Right Law” of our country, when the registration is validated, the unregistered property right does not change; under the condition of registration confrontation, if the change of real rights can not be confronted with a bona fide third person without registration, the determination of the bona fide third party should be effective, Paid transactions and the main obligations have been fulfilled.
