当前,在由计划经济向社会主义市场经济过渡时期,特别是在建立现代企业制度过程中,作为劳动关系的两个主体——企业与劳动者之间,在总体利益上是一致的,但由于产权关系的变更,各项政策法规的不完善,加之企业缺乏健全的自我约束机制和宏观调控、监督监察手段相对滞后等原因,目前,在劳动用工管理方面存在一些混乱现象,有的甚至出现违法行为,需要引起有关部门的高度重视,并采取相应措施加以解决和完善。一、存在的问题一是滥用用工自主权。个别企业片面理解《条例》赋予的用工自主权,招工不公开,不按规定办理招工录用手续;招用农村劳动力呈无序状态,未经劳动部门批准私自招用农村劳动力的现象比较严重;部分乡镇企业和个体企业中存有非法使用童工的现象。
