GATT1994第24条、GATS第5条以及1979年《关于发展中成员方差别待遇和更优惠待遇、互惠和更全面参与的决定》中规定的区域贸易制度,形成了WTO最惠国待遇的一项重要例外。这些规定本身的模糊性,特别是对于透明度要求的含糊不清,促使WTO各成员方意识到透明度机制的重要性,并催生了《关于〈区域贸易协定透明度机制〉的决议》。但是,在实践中,其通报的执行情况也暴露了一些问题,归纳、分析这些问题,对于今后在适用透明度机制时合理恰当地选择委托执行机构具有积极的作用。
Article 24 of the GATT 1994, article 5 of the GATS and the regional trading system set forth in the 1979 Decision on Differential Treatment and More favorable Treatment, Reciprocity and More Full Participation of Developing Countries form a major exception to the most-favored-nation status of the WTO . The ambiguity inherent in these provisions, and in particular the lack of clarity in the requirements for transparency, prompted members of the WTO to beware of the importance of a transparency mechanism and spawned the “Resolution on Transparency in Regional Trade Agreements.” However, in practice, the implementation of the circular also revealed some problems. To sum up and analyze these issues has a positive effect on the future selection of the entrusted implementing agency in a reasonable and appropriate manner when applying the transparency mechanism.
