法制现代化研究,经过学者的努力和实践的推动,已经取得了一定的成就。然而,时于其基本概念所隐含的诸般前提性假设,本文不认为是不证自明的。基于此,在罗列了各种样式的现代化及法制现代化概念的基础上,本文对其前提性假设进行了初步的分析,提出了若干与时下学界并非完全一致的结论。
Research on the modernization of the legal system has made some achievements through the efforts of scholars and the promotion of practice. However, this article is not to be taken as self-evident when it comes to assumptions underlying the underlying concepts. Based on this, on the basis of enumerating the various concepts of modernization and legal system modernization, this article has carried on the preliminary analysis to its premises hypothesis, and put forward some conclusions that are not exactly the same with current academic circles.
