亚洲加价是指亚洲国家自中东进口原油时比欧美国家平均支付更高的价格,其原因是以沙特阿美石油公司为首的中东国家石油公司对出口实施模式定价并施加目的地条款限制。本文从法学视角论证:沙特阿美石油公司构成WTO法上的国营贸易企业;模式定价理念本身与WTO相关规则没有根本冲突,但是其实施缺乏透明度,尤其是与目的地条款相结合具有非法性。中国政府对此应有充分的认识,并联合其他亚洲国家寻求终止该价格歧视之做法。 Asian fare increase refers to Asian countries in the Middle East to import crude oil than the average U.S. and European countries to pay a higher price because the Saudi Arabian oil company headed by the Middle East oil companies export pricing model and impose a destination clause restrictions. This article argues from the perspective of law: Saudi Aramco forms the State-owned trading enterprise in the WTO Law. There is no fundamental conflict between the concept of model pricing and the WTO-related rules, but the lack of transparency in its implementation, especially with the terms of destination, is illegal. The Chinese government should fully understand this and join other Asian countries in seeking to end this price discrimination.
