《全面推进依法行政实施纲要》(国发[2004]10)发布以来,行政裁量问题愈发受到中国行政法理论和实务界的共同关注。本文从近年来全国大量裁量基准的出现这一行政法现象出发,对用裁量基准控制行政裁量进行理论反思,借鉴国外相关经验,构建适合我国国情的行政裁量控制模式。文章认为,我国最理想的行政裁量控制模式是将规范行政主体特别是公务员与监控行政裁量的整个过程,包括事前,事中和事后救济相结合的全方位控制模式,即以程序的竞争性控制为核心,结合事先的规则控制和事后的审查控制,“三位一体”所形成的系统模式。
Since the release of the “Outline for the Implementation of the Law Enforcement by Law” (GF [2004] 10), the issue of administrative adjudication has been receiving more and more common attention from the theories and practical circles of China’s administrative law. This article starts with the appearance of a large number of national standards in recent years, starting from the phenomenon of administrative law, conducts theoretical reflection on the control of administrative discretion on the basis of discretion, draws lessons from relevant foreign experiences and constructs an administrative discretionary control mode suitable for China’s national conditions. The article holds that the most ideal mode of administrative discretion control in our country is to control the entire process of the administrative subject, especially the civil servants and the monitoring of administrative discretion, including the omni-directional control mode combining ex ante, incident and ex post remedies, that is, the competitive control As the core, combined with the prior rule control and ex post facto control, the systematic model formed by the “Trinity”.
