中国在世贸组织争端解决机构中的接连败诉,充分说明目前在转变政府职能、深化经济体制改革的同时,我们对来势汹汹的国际贸易争端准备不足,对WTO规则的研究不够深入和透彻,没有准确把握好政府管理自主权和贸易自由化之间的平衡,造成诉讼中的被动局面,凸显了我们把握和运用WTO规则能力的欠缺。国际贸易争端本质上是WTO倡导的贸易自由化和各国奉守的政府管理自主权之间的博弈,在世界经济高度一体化的今天,合理利用WTO规则,最大限度地提升政府管理权的使用空间,具有十分重要的战略意义。本文以服务贸易为切入点,通过深入分析和研究GATS相关条款的涵义,提出如何在WTO规则允许的情况之下,积极拓展中央或地方政府的管理权限,从而最大限度地保护和发展国际服务贸易。

This article takes service trade as an entry point, through analyzing and studying the connotation of GATS clauses in detail, proposes how to expand the management right of central or local government under the circumstance of WTO rules, so as to maximize the protection and development of international service trade .
