企业是市场上主要的经济组织,存在着多种法律形态,其中公司制企业和股份合作制企业都是企业组织的存在形式。同为企业,就必然有着许多共同之处,但是不同的企业法律形态也必然存在各自的独特性,本文通过将《公司法》和《上海市暂行办法》、《北京市办法》等相关文件比较的方式来探讨公司制企业与股份合作制企业的异同点。
