第三方参与立法在地方层面已具有相当数量和类型丰富的实践探索和制度尝试,通过对近15年来第三方参与地方立法的分析,可以发现一种融会竞争与合作元素的第三方参与立法模式已具雏形。这一模式的构建将有助于推动科学立法、民主立法目标的实现,但这一模式的展开,还应当优化单一第三方的类型,融会多数第三方的竞争与合作,并进一步规范第三方参与立法的进路。
