少数民族女性佩戴面纱其初衷是遵守古兰经关于女子遮体的教义或者出于对本民族习俗的传承需要。但是现实生活中,这种做法总是与周边公共环境的维护格格不入,甚至违背法律法规强调的在特殊场合下卸下面纱,露出本人真实面孔,接受安检人员验明正身的规定。当前我国《宪法》规定,各民族都有保持或者改革自己风俗习惯的自由。所以常常有学者以宪法是最高法,任何法律法规都要服从其规定为由,指出了为宪法所保护的民族风俗必须得到贯彻,不容侵犯。而《宪法》规定的民俗或信仰是否可以成为公然违背法律法规的藉口,有待进一步的论证。
The original intention of the ethnic minority women to wear the veil was to follow the Quran’s teachings on the woman’s cover or to inherit the custom of this nationality. However, in real life, this practice is always incompatible with the maintenance of the surrounding public environment. Even in violation of the laws and regulations, it is also unloaded on special occasions to expose my real face and to be checked by security personnel. At present, our “Constitution” stipulates that all ethnic groups have the freedom to maintain or reform their own customs and habits. Therefore, some scholars often take the constitution as the supreme law and any laws and regulations obey their stipulations, pointing out that the ethnic customs protected by the Constitution must be implemented and inviolable. Whether the folklore or belief stipulated in the Constitution can be used as an excuse for blatantly violating laws and regulations requires further proof.
