“国际法不加禁止的行为所产生的损害性后果的国际责任”(简称国际赔偿责任)是近年来国际法委员会编纂的重要议题之一。本文介绍了国际法委在该议题上编纂的最新进展,探讨了国际赔偿责任的性质——其是否所谓的“合法行为责任”及其与传统的国家责任的主要区别所在;国际赔偿责任的以严格责任为主,辅以公平等因素的考虑的归责原则,以及国际赔偿责任的法律根据等问题。最后,该责任制度的发展将对国际法上整体的责任体系及其他相关领域产生重要影响。
“International liability for injurious consequences arising out of acts not prohibited by international law” (hereinafter referred to as international liability) is one of the important topics codified by the International Law Commission in recent years. This article presents the most recent progress being made by the International Law Commission in its codification on the issue and explores the nature of international liability - whether it is so-called “legitimate acts” and what distinguishes it from traditional national responsibilities; the strict liability of international liability Responsibility, supplemented by fairness and other factors considered the principle of attribution as well as the legal basis for international liability and other issues.
