共同但有区别的责任原则是国际环境法中有关全球环境问题责任分担的一项基本原则,其确立与发展的历程折射出错综复杂的南北关系。本文围绕该原则的南北分歧与争议,从南北关系视角分别对其发展历程、理论基础、实践运用及未来走向几方面进行分析与探讨,同时指出发展中国家应以共同但有区别的责任原则的确立为契机,努力促成其习惯国际法地位的形成,以推动国际环境新秩序乃至国际经济新秩序的建立。
The principle of common but differentiated responsibilities is one of the basic principles governing the sharing of responsibility for global environmental issues in international environmental law. The course of its establishment and development reflects the complicated North-South relationship. Based on the principle of North-South disagreement and controversy, this article analyzes and discusses its development course, theoretical basis, practical application and future direction respectively from the perspective of North-South relationship. At the same time, it points out that developing countries should take common but differentiated responsibility principle Established as an opportunity to make efforts to promote the formation of its habitual status of international law so as to promote the establishment of a new international environmental order and even a new international economic order.
