犯罪侦查,是指侦查机关在办理犯罪案件过程中,依照法律进行的专门调查工作和有关的强制性措施。它是一项刑事诉讼活动,受国家法律的指导和制约。一切侦查活动,都必须严格遵循国家法律的有关规定进行。 在法制不断完善的今天,犯罪侦查更要特别重视以下几个法律问题: 一、现场勘查必须邀请见证人 现场勘查,是犯罪侦查中的一项专门调查工作。它是绝大多数犯罪案件侦查工作的起点,是侦查人员依照法律的规定,对犯罪案件发生的地点和遗留有与犯罪有关的痕迹、物品的一切场所所进行的实地勘验和调查研究。现场勘查的目的,是判明事件性质,发现和搜集犯罪痕迹、物证,分析研究犯罪分子实施犯罪的情况和犯罪分子的个人特点,确定侦查范围和方向。 我国刑事诉讼法第三十一条规定,现场勘查笔录是刑事诉讼证据之一。
Criminal investigation refers to the special investigative work and relevant mandatory measures conducted by the investigating organ in handling criminal cases in accordance with the law. It is a criminal proceedings, under the guidance of national laws and constraints. All investigation activities must be conducted in strict accordance with the relevant provisions of national laws. In the continuous improvement of the legal system, criminal investigation should pay special attention to the following legal issues: First, on-site surveys must invite witnesses to conduct site surveys, which are a special investigation in criminal investigations. It is the starting point of the vast majority of criminal investigation work. It is the field investigation and investigation conducted by investigators in accordance with the law on the location of crime cases and all the places where crime-related traces and articles have been left. The purpose of site survey is to identify the nature of the incident, to find and collect traces of crime, material evidence, analyze the criminals to commit crimes and criminal characteristics of the individual to determine the scope and direction of the investigation. Article 31 of China’s Criminal Procedure Law stipulates that on-the-spot investigation transcripts are one of the evidences of criminal proceedings.
