案例指导制度与英美法系的判例法不同,是具有中国特色的一种司法制度。应对作为中国问题的“同案不同判”现象,发挥弥补制定法缺陷、统一司法适用、规范法官自由裁量权的深层次价值目标,亟需重视和“应当参照”指导性案例,使案例指导制度走出一条具有本国特色的法治之路。
The case guidance system is different from the case law of Anglo-American legal system, which is a kind of judicial system with Chinese characteristics. To deal with the phenomenon of “same claimants and different claimants” as the issue of China, it is necessary to give play to the deep-rooted value goals of making up deficiencies in the formulation of laws, unifying the application of justice, and regulating the discretion of judges. Therefore, it is imperative to attach importance to “guiding reference cases” So that the case guidance system out of a rule of law with its own characteristics of the road.
