网络空间的存在及其全球性、管理非中心化的特点,使国际私法中司法管辖权发生动摇,为此,各国都在进行探索,但做法不一,由此在司法实践中引起了一定的混乱。文章从网络侵权概念的界定分析入手,探讨了互联网上侵权案件对传统管辖权的冲击,介绍了互联网上侵权案件管辖权的各种理论学说,如管辖权相对论、网址来源国法规则、国际礼让原则、最低限度联系原则等及司法实践,加上最高人民法院对网络侵权案件管辖的司法解释存在缺陷,基于此,本文对我国采取的网络侵权案件管辖规则进行了探讨,并提出了相应建议。
The existence of cyberspace and its global, non-centralized management features have destabilized the jurisdiction of private international law. Therefore, all countries are making explorations but different approaches lead to a certain amount of judicial practice confusion. Starting with the definition of the concept of Internet infringement, the article explores the impact of infringement cases on the traditional jurisdiction over the Internet, and introduces various theoretical theories on the jurisdiction of infringement cases on the Internet, such as the theory of jurisdiction relativity, the source code law of origin, the principle of international comity , The principle of minimum contact, and judicial practice. In addition, the Supreme People's Court has flaws in the judicial interpretation of the jurisdiction over Internet infringement cases. Based on this, this article discusses the jurisdiction rules adopted by China in Internet infringement cases and puts forward corresponding suggestions.
