本文在紧密结合司法实践和相关法律、国际条约的基础上,重点从三个方面展开对“类似商品”法律判断的讨论。第一部分主要分析和界定与“类似商品”有关的几个概念的含义,第二和第三部分分别从正反两个方面就判断的依据、标准和因素等作出讨论。基本观点是:(1)“类似商品”的判断属于个案事实的认定问题;(2)判断“类似商品”应注意对“类似商品”、“商品类别”、“商品的自然特性”以及“商品名称”等几个不同概念加以区分;(3)《商标注册用商品和服务分类表》、《类似商品和服务区分表》及有关商品划分的标准化分类不仅不应成为“类似商品”的判断依据和标准,且其参考价值亦十分有限;(4)“类似商品”判断需要综合多方面的因素加以考虑,本文试图对此提出一个系统的和具有操作性的判断方法,包括判断指导原则、主观标准、客观标准和比较对象等。
Based on the close combination of judicial practice and relevant laws and international treaties, this article focuses on the discussion of the legal judgment of “similar goods” from three aspects. The first part mainly analyzes and defines the meanings of several concepts related to “similar goods ”. The second and third parts discuss the basis, criteria and factors of judgment respectively from the positive and negative aspects. The basic point of view is: (1) The judgment of “similar goods” belongs to the determination of the facts of the case; (2) The judgment of “similar goods” should pay attention to the definition of “similar goods”, “ (3) ”Classification of goods and services for trademark registration“, ”Table of similar goods and services,“ and the standardization of the division of goods The classification should not only be used as a basis and standard for judging ”similar products“, but also its reference value is very limited. (4) Judgment of ”similar products" needs to be considered in many aspects. This article attempts to propose a Systematic and operational judgments, including judgment guidelines, subjective criteria, objective criteria and comparative objects.
