徐壮.系制药企业集团公司业务员。2002年,他与公司双方订立了三年的劳动合同。劳动合同期满后没有续签新合同,但人却一直在公司继续工作。2006年10月10日,徐壮向公司递交了辞职报告,公司原则上同意他辞职,但要求他支付违约金5000元。否则,公司将不为其办理档案、社会保险转移手续。徐壮几次找公司领导说理,但都没有解决。无奈,他只好将公司告上仲裁庭,要求公司为其办理相关手续,并转移社会保险关系。
