国际竞争规则的协调早在20世纪40年代即已开始,随着国际经济交往的日益频繁,到20世纪90年代,竞争领域的国际调整引起越来越多的关注。依照微观经济学原理,统一的竞争法规则与标准是真正能够达到最佳市场配置的理想途径。各国为本国利益考虑而推行的某些竞争政策有时阻碍了国际竞争的良性发展,而不一的竞争标准和重复的程序性要求,也为企业的跨国交往造成了困难。但是创建国际统一竞争法律体制的实践却举步维艰,需要我们重新细致地检视在国际各个层面已经作出并正在作出的竞争规则协调的努力及其成果,寻找突破之道。
As early as the 1940s, the coordination of international competition rules started. With the increasing frequency of international economic exchanges, international adjustment in the field of competition attracted more and more attention in the 1990s. In accordance with the principles of microeconomics, the uniform rules and standards of competition law are the ideal way to achieve the best market allocation. Certain competition policies promoted by countries for their own interests have sometimes hindered the sound development of international competition. Different standards of competition and repetitive procedural requirements have also created difficulties for transnational corporations. However, the practice of creating an international unified competition law system is struggling and requires us to review carefully the efforts and achievements made at various levels of the international community in the coordination of competition rules that have been made and are seeking breakthroughs.
