本文对不受约束的仲裁员裁量权提出了疑问。作者首先认为,对仲裁庭缺乏程序约束,其产生的问题比其所解决的问题更多,而且常会使人产生一种印象,即“临时法官”损害了争端解决程序的合法性。继而,作者对关于自由裁量的成本和利益的现行传统观点提出了挑战。最后,作者探讨了在国际仲裁规则中将一套更为精确的程序约定纳入机构规则之中加以适用(除非诉讼当事人明确排除缺省规范)的可行性。
This article questions the discretion of uncontested arbitrators. The author first argues that the absence of procedural constraints on arbitral tribunals creates more problems than they solve, and often leads to the impression that “interim judges” undermine the legitimacy of dispute settlement procedures. In turn, the authors challenged the current traditional view on the costs and benefits of discretion. Finally, the author explores the feasibility of incorporating a more precise set of procedural conventions into the rules of the organization in international arbitration rules (unless the litigant specifically excludes default ones).
