消费者作为经济法的主体,承载着推动经济的重要作用,因而其权利的保护是经济法的重要任务之一。我国现存的消费者维权诉讼机制有极大地缺陷,再加之现阶段新型消费侵权的出现,以及消费者权益纠纷本身所具有的特殊性,使消费者的权益不能切实的得到维护。因此,应当对该类纠纷的解决做出特殊性的程序制度的安排,建立有效的消费者纠纷解决途径,使消费者诉讼意识由“私益”向“公益”转化,从而逐步实现经济法的本质“社会整体利益”的维护。
As the main body of economic law, consumers bear the important role of promoting economy. Therefore, the protection of their rights is one of the important tasks of economic law. The existing litigation mechanism of consumer rights protection in our country is extremely flawed. Combined with the appearance of new-type consumer infringement and the particularity of consumer rights disputes, the rights and interests of consumers can not be effectively maintained. Therefore, it is necessary to make a special arrangement of procedural system for the resolution of such disputes and establish an effective way to resolve consumer disputes so that the awareness of consumer litigation can be transformed from “private benefit ” to “commonweal ” so as to gradually realize The Essence of Economic Law and the Maintenance of the Interests of the Whole Society.
