勒内.达维德是当代法国著名的比较法学家,一生著述颇丰。他首次将“马达加斯加和非洲各国法”作为一个单独的法域提出来加以研究,体现了他对非洲法研究的高度重视。1954年,达维德应埃塞俄比亚皇帝海尔.塞拉西之邀,为埃塞起草民法典。达维德博采众长,充分发挥作为比较法学家的优势,于1960年5月5日完成了《埃塞俄比亚民法典》的编纂。该法典可能因为过于先进而不完全符合埃塞国情,但由于它汇集了法国自其颁布民法典150多年以来的特别法立法经验、判例和学说的精华,以及其他国家的先进经验,在结构和内容上均有许多可借鉴之处,从而促进了埃塞的法律发展与社会进步。
René Davide is a famous contemporary French comparative jurist who has a long history of writing. For the first time, he studied “Madagascar and the laws of other countries in Africa” as a separate jurisdiction, which shows his great importance to the study of African law. In 1954, Davide drafted a civil code for Ethiopia at the invitation of the Ethiopian Emperor Haile Selassie. Davide Bocaizhongzongzong, give full play to the advantages of comparative jurists, on May 5, 1960 completed the “Ethiopian Civil Code,” the compilation. The Code may not be entirely in conformity with the Ethiopian situation because it is too advanced, but because it brings together the best of France’s legislative experience, jurisprudence and doctrine since its enactment of the Civil Code more than 150 years ago, as well as the advanced experience of other countries, There are many contents that can be used for reference, thus promoting Ethiopian legal development and social progress.
